1. Who we are
brazilianflorist.com ("the website") is operated by Unigifts Presentes Especiais Ltda, a company registered in Brazil under CNPJ 35.237.737/0001-07, with its registered address at Rua Mourato Coelho, 468 - Loja, São Paulo, SP, Brazil, trading as "Brazilian Florist" ("we", "us"). Orders are prepared and delivered by our own atelier in São Paulo or by independent partner florists in the recipient's city, acting on our behalf. You can contact us at hello@brazilianflorist.com.

2. Using the website
By placing an order you confirm that you are at least 18 years old, that the information you provide is accurate and that you have the right to give us the recipient's name, phone number and address so that we can deliver the gift. These Terms, our Delivery Policy, our Cancellation & Refund Policy and our Privacy Policy form the agreement between you and us.

3. Orders and acceptance
Your order is an offer to buy. We accept it when we send the order confirmation e-mail. We may refuse or cancel an order, with a full refund, when a product or delivery area is unavailable, when we cannot verify the payment, when we suspect fraud, or when the card message is unlawful or offensive.

4. Prices, currency and payment
Products are priced and charged in Brazilian reais (BRL). Amounts shown in US dollars, euros, pounds or other currencies are approximate conversions for your convenience; the exact amount in your currency is set by your card issuer, bank or PayPal at the moment of payment, and any conversion or international transaction fee they apply is your responsibility. Prices include Brazilian taxes. The delivery fee is shown before payment. We accept major credit and debit cards, PayPal and international bank transfer; bank-transfer orders are confirmed only when the funds are received. We may ask for additional verification before accepting a payment.

5. Delivery
Delivery is available within Brazil only, under the conditions of our Delivery Policy, including same-day cutoff times, delivery windows, address confirmation with the recipient, deliveries to hotels, hospitals, offices and apartment buildings, and what happens when the recipient is unavailable.

6. Substitutions and product images
Flowers are a natural, seasonal product and every arrangement is hand-made by a local florist. Product photos are illustrative. We may substitute flowers, colors, containers or basket items with items of equal or greater value, keeping the style of the arrangement, as described in our Delivery Policy.

7. Card messages and sender identity
We print the message you write on a card delivered with the gift. We do not disclose the sender's identity to the recipient unless you ask us to, unless it is necessary to complete the delivery (for example when the recipient will not accept an anonymous delivery), or unless required by law.

8. Cancellations, problems and refunds
Cancellations, replacements and refunds are governed by our Cancellation & Refund Policy.

9. Personal data
We process your personal data and the recipient's personal data in order to deliver the gift and to communicate about the order, in accordance with the Brazilian General Data Protection Law (LGPD) and our Privacy Policy. The recipient's phone number is used only to arrange the delivery.

10. Intellectual property
The website, its texts, photos, logos and design belong to us or to our licensors and may not be copied or used without our written permission.

11. Liability
We are responsible for delivering the order as described. To the extent permitted by law, our liability for any order is limited to the amount paid for that order. We are not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, strikes or incorrect information provided at checkout. Nothing in these Terms excludes rights that cannot be excluded under Brazilian consumer law or under the mandatory consumer law of your country of residence.

12. Changes to these Terms
We may update these Terms from time to time. The version published on the website at the time of your order applies to that order.

13. Governing law
These Terms are governed by the laws of the Federative Republic of Brazil. Disputes will be submitted to the courts of São Paulo, SP, Brazil, without prejudice to the mandatory consumer-protection rules that apply to you.
